If a person dies in Spain without having a will in place, their estate must go through the intestate probate process. This process can be a little more complicated than standard probate, as there are specific rules and procedures that must be followed.
The Intestate Probate Process
The intestate probate process in Spain typically involves the following steps:
- Identification of Heirs: The first step is to identify the deceased person’s legal heirs. This can be done by obtaining a copy of the deceased person’s birth certificate and marriage certificate.
- Appointment of legal representative: Once the heirs have been identified, it is prudent to appoint a representative in Spain.

The Role of Witnesses
Two witnesses who knew the deceased person must sign a statement in front of a notary.
